It is believed this image is covered by the U.S. fair use laws because:

  1. No free equivalent is available or could be created that would adequately give the same information since the image is of a copyrighted character.
  2. The screenshot does not replace the original market role of the movie.
  3. The movie has previously been published but is believed not to affect the copywright holder in anyway.
  4. The image meets general Wikipedia content requirements.
  5. The screenshot is used to illustrate the film and one of the lead actors, and to represent something of the characterisation, as well as such other aspects as cinematography, costuming, location, style and mood. Additionally, the image contributes significantly to the article by illustrating one of the lead actor's appearance in KANK, which is specifically discussed in the article as Bollywood's biggest internaional hit overseas of all times, simultaneously becoming her fourth international top grosser in four consecutive year, and Zinta's performance was very well received by critics. The image supports and illustrates discussion of the role in her article, as well as critical comments that are provided in relation to this particular performance, specifically to perception of her as an independent, stylish, western and modern Indian fashion magazine editor. The image thus adds depth to the article by providing a visual representation that illustrates pertinent points in the article, in a clearer manner than could be achieved with prose alone.
