This software is copyrighted, but its screenshot is being used in the Windows Live Toolbar article under U.S. fair use laws, because:

  • it helps to visually identify the software; in that sense it furthers the goal of providing verifiable information.
  • it does not limit, nor does it claim to, limit the rights of the copyright holder.
  • it does not, in any way, assist in illegal reproduction of the software or any other things covered by the license of the software.
  • it is being used for informational purposes.

The screenshot also includes portions of the chrome from Internet Explorer 7. Even though the article does not discuss IE7, its presence is also justified under fair use, as Windows Live Toolbar is an add-on to IE7. It cannot run unless hosted in Internet Explorer (version 6 or 7). Since neither version is free, screenshots of a freely licensable UI chrome cannot be provided. The presence of portions of IE7 UI also:

  • does not limit, nor does it claim to, limit the rights of the copyright holder.
  • does not, in any way, assist in illegal reproduction of the software or any other things covered by the license of the software.
  • is being used for informational purposes.

The screesnhot also shows content from an article in Wikipedia. The article in question is Sunrise, and the content of the article is licensed under GFDL,
