The video is copyrighted, but its use in the WinFS article qualifies as fair use because:

  1. the WinFS concept deals with abstract concepts. So, for better comprehension, more than text is needed.
  2. the article describes using relationships as dynamic filters, but since no application does this yet, mockup screenshot is needed to comprehend how it might be presented in the UI. And this video is the only source of mockups.
  3. the WinFS project has been cancelled, with all public preview releases expired. So, there is no chance of creating a demo product for illustration and releasing it under a free license.
  4. this does not limit, nor does it claim to limit, the rights of the copyright holder.
  5. this is a single frame from a two and a half minute video.
  6. it does not assist in illegal reproduction of either the video or the mockup software or the runtime whose concept it aims to promote.
  7. it is being used for informational purposes.

The thumbnail images in the mockup are also irreplaceable, as this screenshot is only a mockup. A screenshot with the thumbnails substituted with free images cannot be created. As a result, they are also covered by the same rationale. Moreover, the company Fabrikaam that it refers to, is a fictional entity created by Microsoft to use as example. As such, it does not include any sensitive information.
