If the photographer is unknown and furthermore unknowable, and if the image documents a historic event in a way that couldn't otherwise be documented, I think any legal argument that would preclude its use is very shaky. I am sure we could find IP attorneys who would represent that Wikipedia is on firm legal grounding in publicizing it. --Leifern (talk) 03:24, 12 February 2008 (UTC)

Where does "probably SS photographer" come from? This is one of the famous Sonderkommando photographs taken illegally by Auschwitz prisoners. See for example Stone, Dan.
