[edit] Summary
Screenshot from the 1973 film The Sting, displaying Robert Redford. This licensing for this film is legitimate, as it is being used in congruence with Wikipedia's policy "for identification and critical commentary on the film and its contents".
[edit] Licensing
This image is a screenshot from a copyrighted film, and the copyright for it is most likely owned by the studio which produced the film, and possibly also by any actors appearing in the screenshot. It is believed that the use of a limited number of web-resolution screenshots
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. |
[edit] Fair-use Rationale
The image satisfies "fair use" doctrines because:
- The image is of inferior quality than the screen capture, and therefore not a threat to copyright holder.
- The image is used for identification and commentary on the fictional character.
- No public free image is available which could replace this.
- The use of the image in no way diminishes the ability of the copyright holder to profit from the original work.
[edit] Fair use rationale for use in American films of 1973
- For an article covering the films released in the USA in 1973, one single screenshot identifying the Academy Award winning film of that year in the absence of any other images significantly contribrutes to the article and illustrates the role and significance of that film in cinemtatic history.
- No free or public domain images have been located for this film or indeed any films of that year.
- The image is of lower resolution than the original (copies made from it will be of inferior quality).
- The image is being used for informational purposes only, and its use is not believed to detract from the original film or affect the copyright holder in any way. The use of the image in that film history article is entirely encyclopedic in nature and is believed to enhance an understanding of film in that year in history.
- The image is used on various websites, and its use on Wikipedia does not make it significantly more accessible than it already is.
