• This image is used to illustrate a major supporting character in a major TV show, The Simpsons, and is used to illustrate what the character of Montgomery Burns looks like in the article Montgomery Burns. Words could not even come close to describing what this character looks like.
• This image was released as a publicity photo from the website [1], an official Fox publicity photo site, and as such should not hamper 20th Century Fox's ability to use or sell this image. Statement on main FoxFlash page states:

"All materials in the FoxFlash Web site, including the photography, graphics and text, are the copyrighted property of FOX BROADCASTING COMPANY, its affiliated companies or licensors, and are distributed to the press solely for the promotion of FOX programming and the news or entertainment media owned or legally licensed by your company. These contents cannot be sold or distributed to a third party, provided however, that syndicates receiving these materials may distribute them to the subscribers solely for distribution in the news or entertainment media. Any other use of these contents is a violation of copyright laws and is prohibited."

The page Montgomery Burns, in which this image is used, does not contain any damaging or disparaging content that could taint the reputation of the show, and, in fact, thus counts as a valid "publicity site" by serving as a way to generate publicity for the show by creating awareness.
