[edit] Summary
a low resolution promotional image of the rock blues band Humble Pie 1969-1975. Sourced from: http://rant58.tripod.com/4fa1d110.jpg Copyright owner Immediate Records
| This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit. The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion. It is believed that the use of some images of promotional material to illustrate:
qualifies as fair use under United States copyright law. Any other usage of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Non-free content and Wikipedia:Publicity photos. Additionally, the copyright holder may have granted permission for use in works such as Wikipedia. However, if they have, this permission likely does not fall under a free license. Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project. If this is not the case for this image, a rationale should be provided proving that the image provides information beyond simple identification or showing that this image is difficult to replace by a free-licensed equivalent. Commercial third-party reusers of this image should consider whether their use is in violation of the subject's publicity rights. |
[edit] Fair use rationale for Humble Pie
This image is being linked here; though the picture is subject to copyright, I, (User:Sue Wallace) believe it is covered by the U.S. fair use laws and give a detailed rationale below:
- Article = Humble Pie
- Use = Infobox
- Description = Low resolution promotional image of the original band lineup showing Steve Marriott, Greg Ridley, Peter Frampton and Jerry Shirley.
- Source = Derived from an image found at http://rant58.tripod.com/4fa1d110.jpg
- It is low resolution (285x273px. file size: 27 KB, MIME type: image/jpeg) Low per Non-free content criteria making it unsuitable for any illegal purpose such as piracy.
- Purpose = To illustrate the appearance of the original band lineup (Steve Marriott died in 1991 and Greg Ridley died in 2003), they disbanded in 1975, this image was taken around 1969. This image was originally created for promotional purposes and has future historical significance. The image (which is nearly 40 years old) is therefore needed for critical analysis in order to complete the and increase the readers understanding and knowledge of the band being discussed in the article.
- Portion = Entire image is used, so that all the band members can be viewed.
- Replaceability = There is no copyright free image available of the band and since two members are now deceased (Steve Marriott and Jerry Shirley) no new copyright free images can be made.
- other_information = This image is already widely distributed to identify the band as part of music catalogs and reviews, so degrade no copyright or market value by providing it here for critical and historical analysis.
- Copyright is owned by record company Immediate Records
