Though this image is subject to copyright, I feel that the fair use provisions of U.S. copyright laws cover its use because:

- ‘’The purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes’’–Use of this image is intended to illustrate the career of Freya von Moltke, a courageous woman whose husband was a leader of the German resistance to the Nazi regime and who was executed by them, as such.
- The nature of the copyrighted work– The photograph comes from a publicity brochure, published in 1949, to promote a speaking tour by von Moltke.
- The amount and substantiality of the portion used in relation to the copyrighted work as a whole–The photograph is approximately one sixteenth of the information content of the brochure. The brochure, itself is ephemera, archived at the University of Iowa and published on the web.
- The effect of the use upon the potential market for or value of the copyrighted work– A search was made for the H. F. Truman speakers bureau in Google, which produced no results. Consequently, it’s difficult to identify anyone to whom market value of the copyrighted work would accrue. Such market value would be negligible.
