Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

1. The image is used in an educational article about the character to illustrate the significant topic in the article of the character's powers.
2. The image well represents a significant aspect of how the character's powers are depicted, and words cannot adequately substitute for this visual information.
3. The image is derived from a single comic book issue's cover. Use of the comic book cover will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original. In particular, copies could not be used to make illegal copies of the book. Further, illustrating of this information from a comic book cover is preferable to using the internal contents of the book, as the cover is displayed to the world regardless of purchase to advertise and identify the product.
4. It is a low resolution image.
5. The image is only a small portion of the commercial product.
6. The character is copyrighted, and so it is impossible to replace it with an uncopyrighted or freely licensed image.
