[edit] Permission Obtained from AP
I received an email today in response to a fax I sent to AP:
-
- Mr. Finley:
-
- I am assistant general counsel for The Associated Press, and I write in response to your fax of March 29, 2005 to AP Wide World Photos on behalf of Wikipedia.
-
- With respect to the two specific photographs you mention – Nick Ut’s Pulitizer Prize-winning image of Vietnamese children fleeing a napalm attack, and Joe Rosenthal’s photo of the flag raising on Iwo Jima – Wikipedia is authorized to display these images to its users solely for their personal viewing and not for copying or redistribution in or through any medium, provided that the images are accompanied by credit in the following manner: Nick Ut / The Associated Press; Joe Rosenthal / The Associated Press.
-
- With respect to any and all other photographs in which The Associated Press is the copyright holder, The Associated Press reserves all its rights, and specifically does not agree that any Wikipedia publication of a copyright-protected Associated Press photo which a Wikipedia user chooses to upload would constitute fair use.
-
- Sincerely,
-
- David Tomlin
- Assistant General Counsel
- The Associated Press
As such I've changed the tagging of the photos and will be working on proper attribution for the pages that use them.

[edit] Fair use review
A fair use review was requested for this image. The image page contains a thorough rationale for fair use based on its inclusion only in article Raising the Flag on Iwo Jima. Unfortunately, this image is now being used in a number of other articles in ways that are patently not fair use. I am going to finalise this review in the negative. As Wikipedia has been granted conditional permission to use the image, this probably need not affect the articles in which it is used. Snottygobble | Talk 06:11, 28 November 2005 (UTC)
[edit] Multiple versions of image
Can somebody go through and delete a lot of the duplicates of the image? I accidently clicked the wrong button and reverted to a prior version. Will the editor with more knowledge of the subject see which one fits best and get the assistance of an administrator to delete the rest? --Nehrams2020 02:16, 14 February 2007 (UTC)
[edit] History of the United States Marine Corps
I notice that this image is also used in the above article, but the image page does not have fair use rational for it. Can we assume that the rational used for United States Marine Corps can also be used as a rational for the history article.? Dsmdgold 03:56, 3 August 2007 (UTC)
