1)It is a low resolution copy of a record cover;

(2)It is the primary visual representation on the article on the musical "The Will Rogers Follies", describing the production recorded on the record;

(3)Using it does not limit the copyright owner's rights to sell the record;

(4)Its use will not enable the distribution of pirated copies of the record;

(5)It is used on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation;

(6)The image cannot be replaced by a free image.
