[edit] Licensing

[edit] Rationale of fair use

The image Image:Whatever Happened to the West album cover.jpg is being linked here; though the picture is originally copyright, I (Jkelly 23:45, 24 February 2006 (UTC)) feel it is covered by fair use because:

  1. No free or public domain images have been, or could possibly be, located for this album.
  2. The image is of lower resolution than the original cover. Copies made from it will be of inferior quality, and could not be used as artwork on illegal CD copies of the album.
  3. The image does not limit the copyright owners' rights to distribute the album in any way.
  4. This is the artwork, intended by New Pleasures for wide distribution. As such, it has future historical significance, and is a more appropriate choice than any other image available. Further, the article Mike Scott (musician) provides critical commentary on the album cover.
  5. This image is used on various websites, so its use on Wikipedia does not make it significantly more accessible or visible than it already is. The cover is being used for informational purposes only, and its use is not believed to detract from the original single in any way.
