Moreover, the image was taken prior to 1923 since the subject was executed in India in 1915. Therefore, by US copyright law, British and Indian copyright law, the original image, if different from this modified image, is not ellgible for copyright. Moreover, there is no loss of revenue. Therefore this image is in fair use.
