[edit] Fair use in List of fictional books
Though this image is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:
- It illustrates an educational article about fictional books, of which several well known examples are depicted.
- The image is used as the primary means of visual identification of the section topic, showing what is meant by a "fictional book" in a way that words alone do not fully convey, by placing it in the context of a fictional library
- It is a low resolution image, and thus not suitable for production of counterfeit goods.
- It is a very small portion of the copyrighted work, and as such has no value for purposes of piracy
- It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
[edit] Licensing
This image is of a book cover, and the copyright for it is most likely owned either by the artist who created the cover or the publisher of the book. It is believed that the use of low-resolution images of book covers
qualifies as fair use under United States copyright law. Other use of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Non-free content for more information. |
