From Wikipedia, the free encyclopedia

This is a low-resolution (40% of original size) scanned image of the frontispiece of the 1885 Macmillan and Company, New York, edition of Tom Brown at Oxford by Thomas Hughes (1822-1896) and illustrated by Sydney Prior Hall (1842-1922). Since the illustrator passed away less than a 100 years ago, the image may still be under copyright. Sanjay Tiwari 15:40, 24 September 2006 (UTC)

[edit] Fair Use Rationale

Although this image, Tombrown_atoxford_frontispiece.jpg, may be subject to copyright, I (Sanjay Tiwari 15:40, 24 September 2006 (UTC)) feel it is covered by the U.S. fair use laws because:

  1. it is a low resolution copy of the frontispiece of the 1885 edition of the book;
  2. the author of the book, Thomas Hughes (1822-1896), died over 100 years ago
  3. the book is out of print
  4. the image will be used only in three Wikipedia articles, all relevant to the image:
    1. Tom Brown at Oxford,
    2. 19th-Century British Chidren's Literature, and
    3. Sydney Prior Hall
  5. it does not limit the copyright owner's rights to sell the art in any way;
  6. copies could not be used to make illegal copies of the cover artwork;
  7. the image of the frontispiece is significant because it is made by a famous artist, Sydney Prior Hall (1842-1922), who was the illustrator of the book
