Though the picture is subject to copyright, I (Josiah Rowe (talk • contribs) 04:29, 30 August 2007 (UTC)) feel it is covered by the U.S. fair use law because:

The image is a low-resolution copy of a promotional photograph from the film Daleks - Invasion Earth 2150 AD;
The image is being used for informational purposes about the character Tom Campbell, as played by actor Bernard Cribbins in the film;
No more free alternative exists, because the image is of a fictional character and all images of the character will have the same copyright status;
The use of the image in this article will have no effect on the copyright holder's commercial use of the image in question.

This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.

The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.

It is believed that the use of some images of promotional material to illustrate:

the person(s), product, event, or subject in question
where the image is unrepeatable, i.e. a free image could not be created to replace it
