Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

  1. It illustrates an educational article about the author of the book, Neal Cassady, for which the book itself is also a significant topic.
  2. The image is used as the primary means of visual identification of The First Third within that article.
  3. The use of the cover will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original. In particular, copies could not be used to make illegal copies of the book.
  4. It is a low resolution image.
  5. The image is only a small portion of the commercial product.
  6. It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
  7. The image is also used as the primary means of visual identification of Neal Cassady, for which purpose it cannot be replaced because Cassady has been deceased since 1968. A freely licensed image of Cassady therefore cannot be created.
  8. The image is historically significant in that it depicts Cassady with his friend and fellow author, Jack Kerouac, and is the image chosen as the cover of Cassady's published autobiography.
