[edit] Fair use in Tenebrae

This image, TenebraeCap.jpg, is being linked here; although the picture is subject to copyright I (Hal Raglan) feel it is covered by the U.S. fair use laws because:

  • According to Wikipedia:Fair use, "film and television screen shots are among the blanket categories of copyrighted images whose use on Wikipedia has been generally approved as likely being fair use when done in good faith." While I have already used the fair use copyright tag associated with film-screenshots, a recent peer review of the Tenebrae article suggested that further explanation might be necessary. The screenshot was copied directly from the Anchor Bay DVD release of Tenebrae. The image has been added to the article to assist in critical commentary/discussion of the film in question.
  1. This image illustrates the text next to which it appears, which describes the film's plot summary and main characters.
  2. The shot visually illustrates John Saxon and Anthony Franciosa, two of the film´s major actors.
  3. It is of much lower resolution than the original (copies made from it will be of very inferior quality).
  4. It does not limit the copyright owner's rights to market or sell the work in any way.
  5. The image is being used in an informative way and should not detract from the original work.-Hal Raglan 22:57, 30 August 2007 (UTC)
