Though the picture is subject to copyright I (Blean) feel it is covered by the U.S. fair use laws because:

it is a low-resolution copy of Clamp's artwork.
it does not limit the copyright owners rights to sell the series on DVD or manga volumes in any way.
it illustrates the relationship between the characters Syaoran and Sakura for their respective articles, aiding commentary on their characterization and development.
there is no free alternative depicting this scene.
The copyright is held by Clamp.
