Though this image is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:
- It is a historically significant photo of an unidentified Portuguese officer surrendering to LT Col Sucha Singh in a captured military camp in Goa shortly after cessation of hostilities.
- The photo is only being used for informational purposes.
- The photograph features an officer of a defeated force surrendering to victorious army shortly after cessation of hostilities. Since the photo has been taken inside of a secure military facility it is unlikely that other images may exist that feature this historic event.
