The supreme court has ruled that you cannot appeal on the grounds of the denial to the right to a speedy trial before the trial has been held: UNITED STATES v. MacDONALD, 435 U.S. 850 (1978). In a later decision they held that the right to a speedy trial commences after indictment - not after suspicion or first arrest: UNITED STATES v. MacDONALD, 456 U.S. 1 (1982). Both cases are in the neverending legal saga of Jeffrey MacDonald. Both decisions overturned 4th Circuit court decisions.user:badtypist
