1. No free equivalent is available or could be created that would adequately give the same information.
2. The image, used here on the non-profit Wikipedia to illustrate the album cover of the album Six of Hearts, is highly unlikely to cause any problems for the band or the label (Kenny G and Arista Records respectively).
3. The image does not inhibit the marketing or promotion of the band.
4. The image is already published, at ArtistDirect.com.
5. The material is relevant to the article Six of Hearts, and thus encyclopedic.
6. The image is of a lower quality than its original.
7. Users are reminded that this image should only be used in the article namespace, and must meet WP:FUC when doing so.
8. The album cover will be used in the article Six of Hearts, so it will not be orphaned.
