Samsung requires a written consent to display the picture, however I believe the image can be considered "Fair use" since the picture contributes greatly to the article by showing the phone's special features (ie the "swivel"). Plus it doesn't infringe on Samsung's copyright since we acknowledge ownership of the picture and the picture doesn't hurt the product.
