| Permission (Reusing this image) |
Fair use of promotional photo to visually identify the subject of the article Rex Stout in the early years of his writing career. The Library of Congress notes that publication may be restricted [1]. The photographs Arnold Genthe made for his own use are considered to be in the public domain, but this photograph was produced as "work for hire" and copyright may be held by the original client — the estate of the Rex Stout or one of his publishers, possibly Morton & Mitchell Kennerley (see "other information" below). |
[edit] Licensing
| This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit. The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion as established by these terms of use. It is believed that the use of some images of promotional material to illustrate:
qualifies as fair use under United States copyright law. Any other usage of this image, on Wikipedia or elsewhere, might be copyright infringement. See Wikipedia:Non-free content and Wikipedia:Publicity photos. |
Though this image is subject to copyright, I feel its use is covered by the U.S. fair use laws because:
- This is an image created and uploaded for informational purposes only.
- The image is an accurate scan (cropped as noted below) of an 8 x 10 black-and-white glossy produced from a film negative in the collections of the Library of Congress
- This image is of much lower resolution than the original. It cannot be used for high-resolution printing, and any copies made from it will be of inferior quality.
- The photograph's inclusion in the Rex Stout article adds significantly to the article because it visually identifies the subject of the article in the early years of his writing career, and the portrait is the work of a prominent photographer.
- The copyright owner's rights to reproduce the image are not limited in any way.

| Other information | Prints of Arnold Genthe's two portrait photographs of Rex Stout, along with 1932 correspondence from the author, are in the papers of publisher Mitchell Kennerley at the New York Public Library (see page 12 of PDF). Morton & Mitchell Kennerley published the British edition of Rex Stout's novel, Seed on the Wind, in 1931, and the Genthe portraits may have been promotional photos for the book's publication. |
