[edit] Fair use for Film noir
This image is being linked here; though the picture is subject to copyright I (DCGeist) believe its use here is covered by the U.S. fair use laws and adheres to Wikipedia fair use policy because:
- it is a low-resolution copy of a movie poster;
- copies could not be used to make illegal copies of the artwork on another poster;
- it does not limit the copyright owner's rights to sell the film or poster in any way; and
- the image adds significantly to the article because it illustrates a historically significant movie referencing the tropes of classic film noir, one that elicited the first ever use by the New York Times of the term film noir as described in the article
[edit] Licensing
This image is of a poster, and the copyright for it is most likely owned by either the publisher or the creator of the work depicted. It is believed that the use of scaled-down, low-resolution images of posters
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. |
