Item is claimed as free under Section 62 (the UK freedom of panorama clause). However, that applies to "works of artistic craftsmanship", not "graphic works" such as murals or paintings. Not sure what's going on here, but the image was correctly tagged and sourced until you changed it. It is a CC 2.0 attribution licence, check the Flickr page. Stu ’Bout ye! 11:03, 22 May 2008 (UTC)
The only change I made to the photo license was to change it from {{cc-by-sa-2.0}} (which was incorrect) to {{cc-by-2.0}} per the Flickr page. My question isn't about the copyright on the photo itself, it's about the copyright on the mural of which the photo is a derivative work. Kelly hi! 12:15, 22 May 2008 (UTC)
Jesus, it's not like we're talking about a Damien Hirst painting - it is a mural on a gable wall in west Belfast. Are all mural photos to be tagged then? You should look at the Northern Irish murals page. Not to mention Banksy's article. Stu ’Bout ye! 21:00, 22 May 2008 (UTC)

<undent>See this entry in the casebook at Commons. Basically, murals are considered unfree, while grafitti is generally not considered eligible for a copyright claim. Since this image doesn't appear to be of illegal grafitti (it looks like the side of a private residence), I'd say it looks like a legal mural. Kelly hi! 15:41, 23 May 2008 (UTC)

Oops. Our documentation asserts that there is an odd quirk in UK law having to do with murals in public places. This is unlike most other laws in Europe. Moreover, I'd never want to be the one to say what's graffiti and what's a mural. In truth, the "mural interpretation" on commons may be mistaken but that's what I have to go by. I don't see any fair use rationale to keep this picture and am now willing to delete it, not under UK law maybe, but under Commons policy. Gwen Gale (talk) 20:21, 30 May 2008 (UTC)
