Though the picture is copyright © to the BBC, I Futurehawk|talk 06:00, 28 August 2007 (UTC)) feel it is covered by the U.S. fair use law because:

1. The image is a low-resolution image retrieved from the copyright holders website where a higher resolution image was available;
2. The image is being used for informational purposes showing an important aspect of the show, namely the ability of the main character to regenerate allowing the show to continue with a new actor playing the same character, this is unique to the television program Doctor Who;
3. No more free alternative exists;
4. The use of the image in this article will have no effect on the BBC's commercial use of the image in question.
