The photo is from the DVD cover of the film Oklahoma! (1955 film), showing the historic photo of Shirley Jones and Gordon MacRae. The recording documents one of the most important movie musicals in history.

The image is used to illustrate the article about the film version of Oklahoma!. The image is also used to illustrate the pages of its author and the author/composer team: the film was the team's most important musical film.

  • The image contributes significantly to the article.
  • The photograph is a low resolution copy of a DVD cover.
  • Using the image does not limit the copyright owner's rights to sell the DVD in any way.
  • The image has been published numerous times, including on many internet sites.

Considering the four factors to be balanced under the "fair use" doctrine of Section 107 of the U.S. Copyright Act:

1. Purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes. The use is non-commercial and is intended merely for informational purposes, to identify the subject of the article or section of an article.

2. Nature of the copyrighted work. The copyrighted work is the cover of a famous film recording and has been copied numerous times and conspicuously on the internet and elsewhere.

3. Amount and substantiality of the portion used in relation to the copyrighted work as a whole. The image represents only one frame of an entire film.

4. Effect of the use upon the potential market for or value of the copyrighted work. Use of the image in these articles will not diminish the market for the film. If anything, it will encourage people to acquire the DVD.
