Under German law, photographs (Lichtbilder) are protected by copyright for fifty years after the date of first publication in the case of anonymous works or works of unknown authorship (Urheberrechtgesetz §72). Consequently, copyright on this image may have expired in October 1987.

Additionally, some works of the German government (including works created by the Third Reich), are not copyrighted under Urheberrechtgesetz §5, and are consequently in the public domain. However, this is not extended to images which have been altered, and it could be argued that this image is altered because the original is a photographic negative, whereas the image above is an electronic file.

  1. It is an image of a unique, once-only event.
  2. The image was intended for wide distribution for propaganda purposes.
  3. Resolution is lower than the original.
  4. There are no known free equivalents.
  5. The image is being used by a not-for-profit organisation to illustrate an historical event for informational and educational purposes only.
