This photo is the one that is the focus of the "Mustard Man" Internet meme. It is low-resolution and hence I contend that it does not infringe on the rights of the subject. It does not affect the commercial value of the original work. It is used in the article for identification of the subject. The photo is not replaceable by a free alternative because the circumstances leading to the photo cannot be replicated.
