[edit] Fair use in Perfect game

The image linked here is claimed by Wikipedia editor DCGeist to be used under fair use as:

  1. it is a widely published news photograph of a pitcher performing for the team with whom he accomplished a unique feat—the only occasion on which a pitcher threw a complete game shoutout victory, surrendered not a single hit, walk, or hit batsman, and retired every opposing player he faced...and still was not given credit for a perfect game
  2. it is of much lower resolution than the original (copies made from it will be of very inferior quality);
  3. the photo is being used only for informational purposes; and
  4. its inclusion adds significantly to the article because it represents the executor of a unique and exceptional near–perfect game, which illustrates the rigor of the official definition.
