It is asserted that the use of this image on pertaining to or in reference to Maryland Public Television (MPT) qualifies as fair use for the following reasons:

• It is a low-resolution copy of the logo;
• It does not affect the market for the original work — this is a logo created to promote a television station, not a commercial work sold to the public for profit;
• By the nature of the image, no free alternative is possible;
• The logo is widely identified with MPT via posters, station id's, advertisements etc. and so the inclusion of the logo adds significantly to the articles in which it is used
