Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

It is a low resolution copy of the image.
It does not limit the copyright owner's rights to sell the image in any way.
Copies could not be used to make illegal copies of the newspaper.
The image is significant because it is the cover for a pivotal event in San Francisco history.
This event covers the ending of three lives, the two that were killed and the assassin who later took his own life as a result of the events described.
