The image linked here is claimed to be used under fair use in the article Jean Charles de Menezes for the following reasons:

This evidence photo is being used in an original encyclopedic article on the death of Jean Charles de Menezes on Wikipedia, The Free Encyclopedia. It is used in commentary on the photo itself, as well as to uniquely illustrate the scene of the death.
The photo itself appears to be the product of a camera phone, and is believed to have been leaked to ITV News by an anonymous whistleblower during the investigation of the case.
The entirety of the image as published by ITV News is used, but using any less of the image would fail to serve the purpose of illustration.
On belief, the image creator released this image to the press for free redistribution in the interest of full public disclosure, and this use is not believed to conflict with that object.

This work is copyrighted and unlicensed.
