The image linked here is claimed by Wikipedia editor DCGeist to be used under fair use as:

it is a single screenshot from a historically significant feature-length film;
it is of much lower resolution than the original (copies made from it will be of very inferior quality);
its use does not impair the copyright holder's ability to sell or promote the film in any way;
it is being used only for informational purposes; and
its inclusion adds significantly to the article because it illustrates the first European feature sound film, as discussed in the accompanying text.
