Photo of Matthew Stirling, posing beside Altar 5 at La Venta. This is a still from Exploring Hidden Mexico (1943) from the Smithsonian Institute National Anthropological Archives.
Although this still, part of a film copyrighted by the Smithsonian, is still under copyright, inclusion here qualifies for Fair Use under US Copyright law because:
- It is used for a non-commercial and educational purpose as allowed by the Smithsonian.
- It is representative of Matthew Stirling, showing him with Altar 5 at La Venta, one of his most famous discoveries.
- There is no public domain photo available of Matthew Stirling since he only became notable after 1923. He passed away in 1975, so it is of course no longer possible to take a photo of him.
- It is only a small part of the overall work, i.e. a single frame from just one of the Smithsonian's films on Stirling.
- It should not affect the commercial viability of the copyright.
