Description

The Baltimore and Ohio Railroad's Marylander, a Washington, D.C.Jersey City, New Jersey train of the 1930s–1950s. The train's 4-6-2 "President"-class Pacific steam locomotive is drawing water from a track pan in New Jersey, in order to maintain its fast schedule (c. early 1940s).

Purpose of use

It is believed that this reduced, low-resolution version depicting the Marylander train in operation is permissible Fair Use solely for the Wikipedia article about the Marylander because:

  1. it portrays this historically significant named passenger train, which operated on the B&O prior to 1956, and depicts the technology used at the time, such as a track pan, for this express train in the pre-diesel locomotive era;
  2. as a greatly reduced, low-resolution version, this image is non-reproducible for commercial purposes.
  3. use of this low-resolution version does not diminish the value of the original media to the copyright holder nor interfere with the media's original purpose, nor will it dilute the importance or recognition of this image in connection with the copyright-holder.
  4. it meets all criteria in WP:NFCC.
Replaceable?

Not replaceable. It is a unique, non-reproducible historic event and no free alternatives are known to exist or can be created, as the train is no longer in operation and the B&O no longer exists as a corporate entity.
