1. The image is being used solely to represent Lopez's appearing on the cover of the November 28, 1994 issue of SI.

2. No fair use photo could be used to replace the image.

3. It does not limit the copyright owner's rights to market or sell the work in any way.

4. This image is of a scaled down resolution (50% the size of the source image) and copies made of it will be inferior.

5. The image is being used in an informative way and should not detract from the original work.

6. It represents an iconic moment of the athlete's life as it represents him being on the cover of Sports Illustrated.
