Although the image is subject to copyright it is covered by the U.S. fair use laws because:

• the game developer has released no such images into the public domain, and a replacement image could not be created that would provide the same information
• is being used for no purpose other than to identify the subject of the article
• it does not limit the copyright owner's rights to sell the game in any way, but may instead encourage sales
• is being used in an informative way only and does not detract from the game
• is of low enough resolution that good copies could not be dreived from it
