Though the picture is subject to copyright I (Kazu-kun) feel it is covered by the U.S. fair use laws because:

• it is a low resolution copy of official artwork released in the Visual Experiments Lain artbook, published by Pioneer LD.
• it does not limit the copyright owners rights to sell the artbook, or the series it belongs to in any way.
• it illustrates the main characters and aids commentary on the plot outline.
• there is no free alternative depicting the main characters of the series.
• The copyright is held by the studio Pioneer LD.
