Due to the lack of any other public domain images in wikipaedia of an Indian President casting his vote, and since this photo captures a historic event in Indian democracy, it is believed that this image is fair use. The specific image does not have free alternative, and hence there seems to be no other way to capture the event in an image. Further, the image is low-resolution.
