Purpose of use

To illustrate the article on this prominent Justice of the High Court of Australia. No image of the judge or anything to do with his work (besides extremely generic photographs) are available that might act as a distinct image to improve this article.

Replaceable?

This image is almost impossible to replace. Photographs of Justice Toohey in court, where he would most likely be seen (even though he is now retired), are illegal and punishable by fines; and by tradition judges in Australia, even High Court judges, do not make frequent public appearances or make public comment. It would be quite impossible in Australia to get a meeting with the judge as they are heavily protected with security. While appearances might happen on occasions, they would be rare and usually limited to specific groups.

Other information As an official photograph, use of this picture on the English Wikipedia would not financially disadvantage the Commonwealth of Australia in any way. Editors should also note Justice Toohey has aged since he departed the court, and the image also serves to show him during his time on the court.
