He was NOT Acting Governor, but Governor. When Governor Tompkins resigned, he, as Lieutenant Governor, succeeds automatically to the post, sworn in or not, in his own right, this being one of the attributions of the office of Lt. Gov. Differently, when the office of Lieutenant Governor falls vacant, the Majority Leader of the State Senate becomes Acting Lieutenant Governor, because he was not elected to be Lt.
