It is believed that the use of this image of the DVD of the 1958 Disney film American Legends, which contains a 19 minute segment entitled The Legend of Johnny Appleseed which has been released as a separate short film, in the article about Johnny Appleseed is allowable under the fair use clause of United States copyright law for the following reasons:

1. It is a low resolution image of the video cover to illustrate the appearance of the film itself, used in a non-commercial educational article about the film.
2. There is no free alternative. Any photograph of or image from the film will have the same issues with the copyright / trademark.
3. It is believed there will be no negative financial impact on the copyright holder from use of the image in this article, especially as it is already used as a promotional image for the film and sales of it.
