Purpose of use

They were in the background when the artist spoke; in any event, though, I (JM) believe their presence enhances the use in the article on the artist himself, because it illustrates some of his work as well as simply showing his face.

Replaceable?

It is imaginable that a picture could be taken of David that raises no fair use issues. In particular, someone could crop or otherwise manipulate this image to remove the background.

Other information GFDL granted by photographer. There could imaginably be a fair use issue because of David's own pictures in the background; I (Joe Mabel) believe that they are at sufficiently low resolution not to present a problem as an illustration of the article about Joe David. Whether this can be released without qualification is another matter, which is why it has not been placed on the Commons.
