It is believed that this image qualifies as fair use under United States law and in compliance with Wikipedia's policy on non-free content for the James Nesbitt article because:

• The image is being used for information and education purposes and to aid critical commentary of the reworked "Murphy" character—specifically the "darker" look and the "Zapata moustache" adopted by Nesbitt in his portrayal.
• The image supports significant commentary on the role from the point-of-view of the actor and appears adjacent to that text.
• A free image of the subject would be unsuitable: Nesbitt wears the moustache for only a few weeks each year while filming the series and shaves it off as soon as filming concludes (see final line of this news item).
• The image is of low-resolution.
• Attribution is provided to the copyright holder, the BBC, and the use of the image will have no effect on the commercial distribution of the series.
• No free or public domain images have been found.
• If a free-use image can be created that can serve the same purpose as this image, this image can be replaced.
