Though the picture is subject to copyright I (_dk) feel it is covered by the U.S. fair use laws because:

it is a low resolution screenshot of a video game;
it does not limit the copyright owner's rights to sell the game in any way;
the image is used to identify the characters in the game, and a free use alternative cannot be found.
