[edit] This case in light of Blakeley line of cases?
I just saw the Court TV version of this case which said that Bailey DID NOT plead to any count related to Ms. Brach's death but that he was sentenced to the maximum for the fraud counts he did plead to based on the judge finding by a preponderance of the evidence as a circumsntance in aggravation that he was so involved. This represents a process that has been squarely rejected by the U.S. Supreme Court in recent years in a number of cases such as Apprendi v. New Jersey, Blakely v. Washington and Cunningham v. California which stand for the precept that facts used in aggravation at sentencing must have been found by a jury to have occurred beyond a reasonable doubt or have been admitted by the defendant. Thus if Court TV's rendition of this case is accurate then Bailey has a strong case for relief in the higher courts.Tom Cod 20:14, 13 October 2007 (UTC)
