This image is believed to meet Fair Use criteria for the article Harpo Marx because it:

• is a single, non-crucial frame of a feature-length film,
• is low resolution (less than television or film),
• does not otherwise compete with the copyright holder's usage of the original work,
• identifies the subject of the article,
• is not replaceable: rare photographs of the subject are typically copyrighted and taken after 1922. The subject was deceased in 1964.
