It is submitted that this image is not replaceable. A freely-licensed image of the subject of the current image, Garðar Thór Cortes, cannot reasonably be found or created as the image is of a specific event – the filming in Iceland of Cortes's music video for the single Luna – which has already taken place.

In any case, as is indicated on the image page, fair use of the photograph under the copyright laws of the U.S., and other jurisdictions where applicable, is asserted for the article "Garðar Thór Cortes" for the following reasons:

• The photograph was specifically released as a promotional photograph on Cortes's official website.
• An image which does not rely on the doctrine of fair use is very difficult to obtain.
• The image is smaller and of a lower resolution than the original photograph.
• No loss of income for the copyright owner can reasonably be expected from the use of the promotional photograph.
